Terms of Use

These terms are the agreement between you and MHB Software, LLC for the Mix app. By downloading or using Mix, you agree to them, so please read them.
The short version
Mix is yours to use to make and share what you like, and anything you create with it belongs to you. Mix is a subscription, with a free trial on the yearly plan, provided as is, with some limits on how it can be used and on what we're responsible for. The details are below.
Apple's standard license, plus these terms
Your use of Mix is covered by Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA"), which you can read at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms of Use add to that agreement. Where the two ever conflict, these Terms of Use control for matters between you and MHB Software, LLC.
The license we give you
MHB Software, LLC grants you a personal, limited, non-transferable, non-exclusive license to use Mix on Apple devices that you own or control, for your own personal creative use, in the ways the App Store rules allow. What you make with Mix is yours, including anything you go on to use commercially.
Subscriptions
Making and editing in Mix requires an active subscription. Anything you have already made stays viewable and exportable without one.
Mix offers a monthly plan and a yearly plan. Both include all of Mix. Prices are shown in the app in your local currency. The yearly plan starts with a 7 day free trial for new subscribers, and the trial converts to a paid subscription unless you cancel at least 24 hours before it ends.
The price you subscribe at is your price for as long as your subscription stays active, even if we raise prices for new subscribers later. If your subscription lapses and you come back, the current price applies.
Payment is charged to your Apple Account when you confirm the purchase, and the subscription renews automatically at the end of each period until you cancel. You can cancel any time in your Apple Account settings or from Manage Subscription in Mix's About page. Cancelling stops the next renewal and leaves the current period untouched. Deleting Mix does not cancel a subscription.
If a renewal payment fails, Apple retries it, and Mix keeps working for a short grace period while it does. Refunds are handled by Apple under the App Store's terms. You can ask for one from Request a Refund in Mix's About page. If you reinstall Mix or move to a new iPhone, Restore Purchases in the app brings your subscription back.
Offer codes we give out are subject to the expiry and conditions shown when you redeem them.
Your content is yours
You keep all rights to the photos you bring into Mix from your own library or camera, and to the collages, edits, and other creations you make with it. Photos and illustrations you pull in from Unsplash are licensed to you by Unsplash under the Unsplash License, and what you can do with them is governed by that license. We don't claim ownership of your content. Because your creations are stored on your own device, you are responsible for keeping your own copies of anything important to you.
Using Mix responsibly
When you use Mix, you agree not to:
- use it to break the law or to infringe someone else's rights, including their copyrights or their privacy,
- use photos of other people in ways they haven't agreed to,
- create or share content that is unlawful, or
- reverse engineer, tamper with, or misuse the app, except where the law expressly permits it.
You are responsible for the content you make and share with Mix.
The app is provided "as is"
Mix is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that Mix will always be available, uninterrupted, or free of errors, or that it will never lose data. Please keep your own backups of creations that matter to you.
Limits on our responsibility
To the fullest extent allowed by law, MHB Software, LLC will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data or creations, arising from your use of Mix. If we are ever found liable for anything related to Mix, our total liability to you will not exceed fifty US dollars ($50) or the amount you paid for Mix through the App Store in the twelve months before the claim, whichever is greater.
Changes to Mix and to these terms
We're actively building Mix, so features may change, appear, or be removed over time. We may also update these terms as the app evolves. When we make a meaningful change, we will update the date at the top of this page. If you keep using Mix after a change, you're agreeing to the updated terms.
Ending the license
This license lasts until it ends. It ends automatically if you break these terms, and you can end it at any time by deleting Mix from your devices. Deleting Mix does not cancel a subscription. Cancel it in your Apple Account settings. The sections meant to last (your responsibilities, the disclaimers, the limits on liability, and the governing-law terms below) continue to apply after the license ends.
Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. If you have a problem, please contact us first at support@mix.photos so we can try to resolve it informally. If we can't, any dispute will be handled exclusively by the state or federal courts located in Los Angeles County, California, and you agree to those courts having personal jurisdiction over you. There is no mandatory arbitration and no class-action waiver in these terms.
